Terms of Service

These terms govern your use of The Tartan (“the Service”), operated by Calverda LLC. By signing in or otherwise using the Service, you agree to these terms. If you do not agree, do not use the Service.

What The Tartan is

The Tartan is a companion app for private golf events. It lets organizers run scoring, group competitions, brackets, Ryder Cup formats, and records of informal side games between participants. Activity notifications are delivered in-app; SMS is optional and carries only one-time sign-in codes and event reminders.

The Tartan is a social tool for peer-to-peer score tracking and informal tallies. We do not handle money, hold funds, process payments, or act as a stakeholder. Any settlement of side games, group competition results, or other obligations recorded in the Service is a private matter between participants and is settled directly between them outside the platform. The records the Service maintains are for participants’ convenience and reference; they do not create a payment obligation between Calverda LLC and any participant.

Eligibility

You must be at least 18 years old to use the Service. You may create your own account, or use the Service if a verified event organizer has invited your email address. Creating and hosting your own events requires approval by an administrator. Sharing your account or using someone else’s account is not permitted.

Your responsibilities

• Keep your email account secure and under your control. We sign you in using one-time codes sent to your email. If you choose to add a mobile number and opt into SMS, keep that number under your control too.
• Use the Service in good faith. Do not attempt to disrupt the Service, scrape or copy data about other participants, or misrepresent yourself.
• Comply with applicable law and the rules of any event you participate in. You are responsible for whether the side games and group competition activities you record in the Service are lawful where you live.

Records of side games and competitions

Side games, group competitions, sheet entries, and any similar features are recorded on behalf of participants. They are not contracts between you and Calverda LLC. We are not a party to, and have no liability for, the underlying obligations. We do not adjudicate disputes between participants beyond the tooling the Service provides for resolution and dispute capture; for anything else, organizers and participants resolve matters among themselves.

Messaging (SMS) program

Program: The Tartan SMS notifications, operated by Calverda LLC.

SMS is optional.Sign-in and all features of the Service work by email; SMS is an optional convenience you choose to turn on, only from your account settings (Settings → Notifications). Opting into SMS is never required to create an account, join an event, or use the Service, and you can use The Tartan without providing a mobile number.

What you can receive (if you opt in): one-time sign-in codes (sent only when you request to sign in by text) and event reminders for events you have joined — round start times, tee-time assignments, and schedule changes. SMS carries nothing else. The full message disclosure is reproduced verbatim on the SMS Disclosure page; how we handle mobile information is covered in the Privacy Policy.

Message frequency: varies. Sign-in codes arrive only when you request one; event reminders are tied to events you have joined — around an event day you may receive a few, outside of event windows you may receive none.

Message and data rates may apply. The Tartan does not charge to send or receive messages. Standard message and data rates from your wireless carrier may apply. Contact your carrier with questions about your plan.

Opting out: reply STOP to any message to unsubscribe from all SMS at any time. Aliases including STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT are also honored. Reply HELP to any message for support information, or email support@calverda.com.

No warranty

The Service is provided “as is.” We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that scoring or standings calculations will be perfectly accurate, or that notifications will always be delivered. We make reasonable efforts but cannot guarantee carrier delivery of SMS or third-party service availability.

Limitation of liability

To the fullest extent permitted by law, Calverda LLC and its affiliates, officers, employees, and contractors are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service. Our aggregate liability for direct damages is capped at one hundred US dollars (USD 100).

Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these terms or use the Service in a way that risks harm to other participants or to the Service. On termination, your right to use the Service ends immediately; retention and deletion of your data is governed by the Privacy Policy.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Disputes shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.

Changes

We may update these terms from time to time. The effective date above tracks the current version. Material changes will be surfaced in the app; continued use after a change constitutes acceptance.
